Dv 2027

@Marenka

The U.S. Department of State has finalized a new rule that tightens the Diversity Immigrant Visa Program, also known as the green card lottery. Under the rule, many applicants will need to provide valid, unexpired passport information and upload a scan of their passport when they submit their entry. The rule takes effect on April 10, 2026.

The upcoming September 24, 2026 court hearing in San Diego is a critical moment for the future of the DV-2027 Green Card Lottery. It marks the next major stage in the lawsuit Red Eagle Law, L.C. v. Marco Rubio, which seeks to force the U.S. State Department to launch the delayed program. [1, 2, 3, 4]

The core details of the hearing and the legal battle include:

:classical_building: The Core Legal Dispute

  • The Plaintiffs’ Claim: Immigration firm Red Eagle Law, L.C. argues that the Immigration and Nationality Act mandates a new Diversity Visa registration cycle every fiscal year. They claim the administration is attempting to “run out the clock” to completely skip the DV-2027 program. [1, 2]

  • The Government’s Defense: The State Department maintains that the registration window has been delayed by technical overhauls—specifically implementing a new $1 entry fee, updated passport rules, and a national security vetting review. [5, 6, 7]

:date: What Happened So Far

  • Temporary Restraining Order (TRO) Denied: On September 3, 2026, U.S. District Judge Jinsook Ohta denied the plaintiffs’ emergency request to instantly force the government to start the program. The judge questioned if it was too early to rule that the government was failing its duties. [1, 2, 8]

  • The Case Advances: Despite the emergency setback, the judge refused to dismiss the case, allowing the broader lawsuit to move forward to a more formal hearing. [2]

:balance_scale: What to Expect at the September 24 Hearing

  • The Motion: The court will hear arguments on a Preliminary Injunction. Unlike the rushed emergency TRO, this motion allows both sides to present a fuller legal case.

  • The Key Legal Question: Judge Ohta specifically asked for deeper arguments on whether an immigration law firm has the proper “zone of interest” (legal standing) to sue the Secretary of State over the lottery’s delay.

  • The Possible Outcome: If the judge rules in favor of the plaintiffs, she could order the State Department to formally announce and open the 30-day DV-2027 registration window. If she denies it, the timeline will remain entirely in the hands of the government’s internal schedule. [2, 3, 4, 7]

The hearing is set for 9:30 AM at the U.S. District Court in San Diego. [3]

**Ohta said she would announce a decision by Oct. 14 during a ruling hearing or in a written order.
